Residence Permit Based on Business Activity in Warsaw

A residence permit based on business activity is intended for foreigners who conduct entrepreneurial activity in Poland, develop a sole proprietorship (JDG), own a company, or participate in company management.

For this type of application, it is important not only to complete the application form, but also to demonstrate that the business is genuine: company registration, financial performance, taxes, ZUS contributions, income, expenses, contracts, clients, and the economic purpose of the activity.

From April 27, 2026, the standard application process for a residence permit is carried out electronically through MOS 2.0. Therefore, business-related documents must be prepared in a way that confirms the legal basis of stay and complies with the requirements for electronic submission to the immigration office.

Documents Required for Applying Through MOS 2.0

Below is the basic list of documents required for applying for a residence permit based on business activity through MOS 2.0. The final package depends on the business structure: JDG, sp. z o.o., participation in the management board (zarząd), shareholder status (wspólnik), turnover, taxes, ZUS contributions, and the actual activity of the company.

  1. Completed electronic application in MOS 2.0.
  2. Digital photograph for submission through MOS 2.0.
  3. Scan or photo of all pages of a valid passport.
  4. Confirmation of payment of the stamp duty of 340 PLN for consideration of the application based on business activity.
  5. Documents confirming health insurance in Poland.
  6. Proof of address in Poland — if required for the case.
  7. Documents confirming stable and regular income.
  8. Business documents: CEIDG or KRS, company agreement (umowa spółki), resolutions (uchwały), management board / shareholder data (dane zarządu / wspólników) — depending on the type of business activity.
  9. Documents confirming actual business activity: contracts with clients, invoices (faktury), bank statements, payment confirmations, reports, documents regarding employees or contractors.
  10. Accounting documents: PIT / CIT, VAT, ZUS, revenue and expense ledger (księga przychodów i rozchodów), or other confirmations of the company’s financial activity.
  11. Application attachment signed electronically — if the basis is related to serving on the management board (zarząd), managing company affairs (prowadzenie spraw spółki), acting as a general partner (komplementariusz), or as a proxy (prokurent).
  12. Translations into Polish — if the documents are issued in another language and require certified translation.
  13. If submitted by a representative — power of attorney (pełnomocnictwo) and confirmation of payment of the 17 PLN fee for the authorization.
  14. Electronically certified scans of paper originals — if additional documents existing only in paper form must be submitted in the case.

After the implementation of MOS 2.0, paper supplements to the case are no longer accepted at the service desk. If the immigration office requests additional documents, they must be submitted electronically. If a document exists only as a paper original, a scan certified electronically as a true copy of the original must be prepared in advance.

Frequently Asked Questions

Do I need to apply for a new residence permit if I change my job?

In accordance with changes in legislation from 2022 regulating the issuance of residence cards, the requirement to obtain a new residence permit when changing employers has been removed. It is only necessary to update the decision (not in all cases).

You may leave the territory of Poland, but for re-entry you will need a visa or another legal basis.

You should inform the authorities about the change of employer and submit a new set of documents from your new employer.

As a rule, the validity period of a residence card based on employment depends on the length of the employment contract, which is specified by the employer in Annex No. 1 (załącznik nr 1).
Other equally important documents should also be taken into account.
