Warsaw

Residence Permit Based on Family Reunification in Poland

A residence permit based on family reunification allows a foreigner to legally live in Poland together with a spouse, parent, child, or other close family member who already has legal status in Poland.

In such cases, it is not enough to confirm only the family relationship. The immigration office also verifies the status of the main family member, marriage or kinship documents, income, housing, insurance, and the real nature of family life.

SKILLDOCS helps prepare applications for family-based residence permits in Warsaw: we verify eligibility, documents, income, housing, translations, and support the entire electronic submission process via MOS 2.0.

What a Family Reunification Residence Permit Provides in Poland

  • Legal residence in Poland for the duration of the permit;
  • The ability to live together with a spouse, parent, or child;
  • Travel within the Schengen Area for up to 90 days in any 180-day period;
  • Possibility to extend the status if the family basis remains valid;
  • In some cases, access to the labour market without a separate work permit;
  • Possibility to register a JDG (sole proprietorship);
  • A pathway to more stable residence status in Poland if legal conditions are met.

Important: the right to work depends on the specific legal basis, the status of the family member, and the content of the decision. This must be verified for each individual case.

Documents for Application via MOS 2.0

The basic list depends on who the main family member in Poland is: a Polish citizen, a foreigner with a residence card, an EU resident, a Blue Card holder, or another status.

Usually required:

  1. Electronic application via MOS 2.0
  2. Scan or photo of all pages of a valid passport
  3. Digital photograph for MOS 2.0 submission
  4. Confirmation of payment for application processing
  5. Marriage certificate, birth certificate, or other proof of family relationship
  6. Sworn translation if the document is not in Polish
  7. Documents of the main family member in Poland: passport, ID card, residence card, decision (decyzja), or other proof of status
  8. Proof of housing in Poland
  9. Documents confirming stable and regular income of the family
  10. Proof of health insurance
  11. Documents regarding children, custody, or parental rights — if applicable
  12. Documents confirming name changes, divorce, or other civil status changes — if applicable
  13. Proof of real family life — if required in the specific case
  14. Access to Profil Zaufany, qualified electronic signature, or personal signature
  15. Electronically certified copies of paper originals if the document exists only in physical form

If the applicant is in Poland, standard applications for a temporary residence permit (pobyt czasowy) are submitted electronically via MOS 2.0 after its implementation. If the applicant is outside Poland, the procedure for family-based applications must be verified separately, as different rules may apply in certain cases.

Frequently Asked Questions

Do I need to obtain a new residence permit if I change my job?

If you received your residence card on the basis of family reunification, you are not obliged to report a change of employment. The basis of your residence permit is your spouse. Therefore, you are only required to notify the immigration office if there are changes related to your marriage.

If your spouse holds a residence card or Polish citizenship, the standard processing time is approximately 3 months from the date of personal submission. However, this deadline is often not met in practice, and the total processing time may range from 1 year to 1.5 years. You should also take into account the additional time needed for printing the residence card.

If your spouse does not yet have a residence card or citizenship, your case will only begin processing after a positive decision is issued for your spouse.

Yes, you may apply for permanent residence provided that:

  • you have continuously lived in Poland for at least 2 years on the basis of a temporary residence card issued due to marriage with a Polish citizen, and
  • at least 3 years have passed since your marriage was concluded.
